SWINDON MAGISTRATES' COURT BOOKS.
It’s never too late to learn. It’s been my habit now for some years to look at various books and documents to which I have no connection but to which I think I should, at least, have a look to cover all options in my research and transcribing pursuits. One day not that long ago, I interrupted my transcribing and decided, on the spur of the moment, to order the magistrates' court books for the town in which I live and which became a borough in 1901. I have had an interest in petty sessions justices' minute books which have proved to be a mine of information, not just for names, but as a source of social and local history. I had no idea when I ordered these turn of the century magistrates' books that I was in for a surprise. I discovered not only family names but names of some of the grandparents of some of my friends. My town, in those days, was not so enormous as it has become to day and which is still growing out of all recognition. In my time and my parents' and grandparents' time, practically everyone knew of or about everyone else or was connected to them either in a close way or a tenuous way.
These books were not only a revelation but they showed how the law had changed from the turn of the new century in 1901 through to the end of the first World War with regard to petty crime and what we would now term minor offences which would never be brought to court at all. In 1914 things began to hot up in the Magistrates' Courts as several new Acts of Parliament appeared on the Statute Books which ensured that even more cases were brought before the Magistrates, not just the usual ones of drunkenness, prostitution, omitting to send a child to school, and evictions from rented accommodation although these continued to be a source of amazement as I recognised many local names.
Browsing through the Court Books and making notes, I was stopped in my tracks by finding the name of a first cousin of my Phillips family for playing football in the street to the detriment of passers by. Fortunately, the case was dismissed but I had the feeling that he had not got away with it for sullying the family name by having to appear in Court. Retribution was not always afforded by the Courts but also by the parent! It didn't take much for my imagination to run riot when I a case brought on the 16 Sept 1915 when a man was found: drunk while in charge of a bull in Wroughton Road three days previously. He pleaded guilty and was fined: 10s and costs. I have to confess, here, that I have appeared twice in court myself, so no doubt I should be on record somewhere in these books. Once, just after I had been married, for buying a pork pie for my tea, which turned out to be green with mould, but the pork butcher who had sold it to me had the local, notorious and wily solicitor appearing for him who literally `wiped the floor' with me and I lost my case! The other was appearing as a witness for a shop theft and to add to my success as a witness, that case was also lost. My husband appeared as a witness for the defence for a traffic accident case and this was won because he had done his homework well before appearing so I am sure that somewhere in records such as these for our home towns we would discover some of our friends and relations. All part of the family history pattern. To a certain extent, family history never ceases as there seems always to be something else lurking to be found, around the corner.
